CJI DY Chandrachud expresses displeasure over adjournment of hearings, cites ‘Tareekh par tareekh’ dialogue

Chief Justice of India DY Chandrachud has expressed concern over the frequent adjournment of the hearing of cases. He also reminded the dialogue of the Hindi film Daminii n which it has been said that the court has repeatedly given dates (Tareekh par tareekh). CJI said that judges do not want this.

The CJI has told the lawyers that the hearing should be postponed only when necessary. He said that he had collected some data. According to them, if we talk only about today, till now a demand has been made to postpone the hearing of 178 cases. Whereas in September and October this year, a demand was made to postpone the hearing of a total of 3688 cases.

Justice Chandrachud said that the demand for postponement of cases defeats the very purpose of speedy hearing. “Let me tell you that this practice is not in the High Courts. If only the hearing is postponed, it will break the trust of the citizens in our judiciary. I request the members of the Bar not to seek postponement of the hearing unless it is really necessary.

“It is wrong to demand postponement of the hearing,” he asserted.

The CJI further told the lawyers that in September, further date was sought in 2361 cases.

“If I tell you, on an average 59 such cases are coming every day. On one hand, cases are listed on an expedited basis and on the other hand, a speedy hearing is sought against them, then they are listed and then they are postponed. I request the members of the Bar not to seek postponement of the hearing unless it is really necessary. If this continues to happen then the court will reduce its significant. This will break the trust of citizens in our courts,” he added.
